Divorce & Family Law Attorney Serving Bensalem

Last updated April 2026

Bensalem is Bucks County's largest municipality. The community is diverse, fast-growing, and increasingly involves families split across state lines. If you're in Bensalem and dealing with divorce, custody, or family law issues, we know the local landscape and the interstate complications that come with it.

Bensalem's Border Location and Cross-State Custody Issues

Bensalem sits on the Pennsylvania-New Jersey border. Many residents work in New Jersey, have family there, or have ex-partners who've moved across the line. This creates custody questions that pure Pennsylvania law doesn't fully answer.

The Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA) determines which state has authority over a custody case. Generally, the child's home state for the last six months controls. But if one parent is trying to move a child to New Jersey or New York, or if a parent in another state is seeking custody, jurisdiction becomes contested. We handle those arguments and work with New Jersey and New York attorneys when necessary. Learn more about custody and fathers' rights in Pennsylvania.

Divorce Filing and Support Enforcement

You file for divorce in Doylestown at the Court of Common Pleas, Family Division. Bensalem's size and diversity means we see a wide range of divorces: quick uncontested cases, high-asset splits, and contested matters that take years. Property division follows Pennsylvania's equitable distribution standard. Support is calculated using income shares, adjusted for parenting time.

Enforcement of child and spousal support goes through the Bucks County Domestic Relations office. If an ex-spouse is shirking payment and lives out of state, we coordinate with that state's child support enforcement agency. It's slow, but it works.

Protection from Abuse Orders: High Volume, Real Stakes

PFA cases are common in Bensalem. When you file for one, you can get an emergency order the same day in Doylestown. If granted, it prohibits contact, mandates distance, and can include provisions on the marital home, vehicles, and custody. The other party gets a hearing within 10 days to contest it.

If you're defending against a PFA, the burden is on the plaintiff to prove abuse by clear and convincing evidence. We challenge credibility, timeline inconsistencies, and whether the behavior actually fits the abuse statute. PFA orders affect custody decisions, so the outcome matters for your entire family law case.

Custody and the UCCJEA

In contested custody cases, the court applies the best-interest standard: each parent's relationship with the child, stability, community ties, school enrollment, and whether either parent has been abusive or neglectful. If the child has lived in Pennsylvania for more than six months, Pennsylvania has primary jurisdiction even if the other parent moves to New Jersey midway through the case.

Custody conciliation through CCES (Custody Conciliation and Evaluation Services) is often required before trial. The evaluator interviews both parents and the child, then submits a recommendation. If you disagree with the recommendation, you can proceed to trial, but the judge will see the evaluation.
